Kaiser Data Breach #1

He's More Than Just a Jerk

What follows is an angry rant I wrote regarding a data breach perpetrated against me by the same psychiatrist, Dr. Missy Stewart, who is also a member of Mr. Roberts' board of directors. 

 

I received the letter confirming the data breach while I was experiencing homelessness and residing in the back of my Highlander. What a helpless feeling that was!

 

The Account:

 

Not once did Mr. Roberts offer to comfort me or validate my feelings. He just walked away when I was shaking and sobbing. He reacted by getting defensive and blame-shifting. To him, everything was a chess match, and he had to constantly one-up me.

 

A few days after my release, he tried the same thing again by calling 911 and saying I was delusional and that I had just been released from a 5150. However, I have never experienced delusions in my entire life, unlike Mr. Roberts. This time, I was prepared and understood what was happening so that I could keep the situation under control. Nevertheless, I was scared and livid.

 

He couldn’t keep me from conducting my own investigation into what happened behind the scenes, and was fearful that his big secret would get out about how devious he really was, and he’s been trying to silence me ever since. I don’t have my notes from when I was placed under a 5150 hold because, unfortunately, I left them behind in the marital home.

 

Mr. Roberts continued to punish me for seeking the truth, and ferreting out the details. My gut was telling me that he was untrustworthy, and I avoided him, staying in the small bedroom or leaving the house and parking somewhere that felt safe.

 

Ultimately, the manipulation, blame-shifting, and dishonesty on his part put such a wedge between us that it was impossible for me to overcome, mostly because I couldn’t ignore the situation. As a result, he punished me relentlessly with his psychological warfare, and his actions were accepted by others as normal. They were anything but normal.

 

I now have a much better understanding of just who Mr. Roberts is: a lost, lonely, empty shell of a human being; an imposter. He’s so good at pretending, that he’s even the CEO of Housing, Inc., a respectable nonprofit serving the community. He needed that cover desperately lest he be found out. I was to remain silenced in order to safeguard his deception.

 

He never truly loved me; I was merely a façade for him. I embodied everything he would never be. It gnawed at him to feel so vulnerable, so close to exposure, and so far below my standards. I uncovered his true self, and now I was the one to pay.

 

These were the flaws of Mr. Roberts that he wanted others to think were mine. Nevertheless, I became the one person who wasn’t convinced.

 

On July 24, 2020, after I questioned Mr. Roberts regarding Dr. Stewart’s involvement, he eventually admitted to finding out from her how to have me placed on a 72-hour hold. In fact, my own therapist, Lauren Erickson, MFT, and psychiatrist Dr. Villari-Lee had no idea until I notified them after my release.

 

Additionally, there was an investigation of specific deleted records in my electronic medical records (EMR); entries made in January 2021 involving Dr. Stewart which had recently been deleted, with PDF documentation showing the discrepancy. In particular, there was one record of Dr. Stewart, showing that she was the one behind referring me to an out-of-network therapist who began taunting me on a weekly basis about how good rabbit stew tasted when he learned my rabbits were my emotional support animals.

 

Then, in October 2021, Dr. Stewart, at Mr. Roberts’ urging accessed my EMR and changed my diagnosis. This was against Kaiser Permanente’s own protocol because I had never been Dr. Stewart’s patient, nor had I ever had any encounters with her, as she claimed in my medical records.

 

There was one investigation which concluded on December 14, 2021 as a result of my filing a grievance. The investigator failed to address any part of my concerns and instead, referred to matters never mentioned by me in my grievance.

 

I don’t have the letter outlining the conclusion of the investigation because Kaiser Permanente mailed it to Mr. Roberts, instead. I had to ask the investigator to read the letter to me over the phone!

 

Mr. Roberts systematically engaged in erratic behavior while simultaneously falsely claiming that it was me who was erratic. It was no wonder he put so much effort into silencing me. None at all.

 

Eventually, I received a confirmation letter from Kaiser Permanente acknowledging the data breach, adding that the physician was apologetic.

 

The letter from Kaiser reads, as follows:

 

“NOTICE OF DATA BREACH

 

May 5, 2022

 

Ms. Sally Freeman

USPS General Delivery

XXXXXXXX Drive

Pacifica CA 94044

 

Dear Ms. Freeman,

 

I am writing to inform you about a medical information privacy matter.

 

What Happened?  On October 25, 2021, a Kaiser Permanente (KP) physician accessed your medical record without your authorization and against KP protocol. The incident is currently under review by Kaiser Permanente. What information was involved? While we believe the risk to the information is limited, we wanted to notify you the physician made a notation in your medical record and viewed your behavioral health information, encounters, contacts, and the summary of your medical record.”

 

Further, the letter states:

 

“…The physician is obligated to protect the confidentiality of your health information and expressed an apology for the incident. Appropriate mitigation of the incident is in progress.

 

On behalf of Kaiser Permanente, we offer our sincerest apology that this unfortunate incident occurred. We assure you that safeguarding your information is one of our highest priorities.”

 

The only way I will be able to get past this is to forgive them. Not for their benefit, but for my own peace of mind!
